The Competition |
| 1. |
By entering Nat Geo Awards, all entrants are deemed to have accepted
and agreed to abide by these rules. |
| 2. |
Information on how to enter this competition and prize details
published on the National Geographic Channel (“NGC”) website at
http://www.natgeotv.co.in/momentawards/ (“Website”) form part of
these Rules of Entry. |
Entrants |
| 3. |
Entrants must be of Indian origin. |
| 4. |
Employees of NGC, or any associated companies, and members of
their families, and anyone directly associated with the competition
are not eligible to enter. |
| 5. |
Entrants can enter the competition only as specified in these
terms and conditions and the competition entry form. |
| 6. |
Winners will be expected to provide NGC such proof of identity
as NGC in its sole discretion requests. |
| 7. |
Failure to comply with any of these terms and conditions (including
instructions) will disqualify any entrant from taking part in the
competition and the entry will be invalid. NGC retains sole discretion
to refuse entrants the right to enter if it feels that these terms
and conditions are being violated. |
| 8. |
NGC reserves the right to disqualify any entrant and/or winner
and/or amend these terms and conditions at any time in its absolute
discretion. |
| 9. |
The pictures, clippings and films uploaded/posted on the Website
shall be so done under an irrevocable, royalty free license and
an applicant hereby accordingly grants NGC the right to use the
picture/clipping in any medium anywhere in the world in perpetuity. |
| 10. |
NGC has the right but not the obligation to use the pictures
or the movie clippings. |
| 11. |
NGC shall make best endeavours to give credit to the author/producer/owner
of the image or the movie, but entrant/applicant acknowledges that
NGC may not always be able to do so due to editorial or other reasons,
determined in NGC’s sole discretion. |
| 12. |
Submission of the picture or the movie clipping does not entitle
a prize. |
| 13. |
The participant will give the undertaking that the submitted picture
or the movie clip is his original work and does not infringe on
any existing IPR. |
Entries |
| 14. |
To enter, Entrants must first register, and complete the entry
form on the Website. |
| 15. |
All entries must be received during the term of the competition
commencing on 24th March 2009 and ending before midnight IST on
24th April 2009 (“Closing Date”). No entries or calls to NGC will
be accepted. Any entry received after the Closing Date will be invalid.
NGC shall not be responsible for any delay/non-delivery of the e-mail
submissions to it. |
| 16. |
No subscription to the National Geographic Channel or any other
purchase whatsoever is necessary for participating in the competition. |
| 17. |
Entrants are responsible for ensuring that the Films (and all
underlying elements) are original, inoffensive, lawfully produced
and technically suitable for broadcast on the Website and the TV
Channel(s) and must not infringe any third party’s rights nor give
rise to any claim. |
| 18. |
The Entrant warrants that they are the sole copyright owners
of the Film, and that they have obtained all necessary consents
and similar releases from the participants in the Film, if any,
and neither the Film nor its exploitation by NGC or its affiliates
will infringe any rights of any third party. |
| 19. |
The Entrant warrants that nothing in the Film is obscene, libelous,
defamatory, blasphemous of or infringes any performer’s right, any
performer’s property right, any moral right, any right of copyright,
right of privacy, right of publicity or any other right whatsoever
of any third party. |
Winner |
| 20. |
Entrants must supply full entry details, including name, residential
address, telephone number(s) and e-mail address. |
| 21. |
Each entry shall be considered and judged individually by the
panel of jury nominated by NGC. Chance plays no part in this competition.
NGC’s decision in this competition is final and no correspondence
will be entered into. |
| 22. |
Winner of the people’s choice award will be declared by NGC after
taking into account the no. of votes the respective photographs
get. The decision will be final and no matters will be entertained. |
| 23. |
The winner will be notified by telephone, email and/or letter
within 28 days of the Closing Date. |
Prizes |
| 24. |
The prizes in the competition may be subject to variation at
the discretion of the NGC, and any change will be final and binding
upon every person who enters the competition. |
| 25. |
The prizes for this competition will be given to the winner as
set out in these terms and conditions. The winner must accept their
prize in that form. Under no circumstances will cash be given as
an alternative. The prizes are non-refundable and cannot be transferred.

| 26. |
Winners will be liable for any taxes or surcharges that may be
levied on competition prizes and for any expenses not specified
in the description of the prizes. |
| 27. |
NGC shall not be liable in any way for any failure or breach
by any party in connection with this competition, prize or prizes
and accepts no responsibility for any loss suffered by an entrant
arising from this competition, prize or prizes. |
| 28. |
In no event will NGC be held liable for a prize if it does not
reach the winner or runner up for reasons beyond its control. |
| 29. |
Only the winner will get a pair of Transitions lenses and the
same is not transferable. |
| 30. |
NGC will not be responsible for the quality of the products given
by Transitions |
| 31. |
The prize given by Transitions is not exclusive. NGC may add
other gratifications at their own discretion |
| 32. |
For the gratification if there is any TDS involved it will be
directly handled between the winner and Transitions. NGC will not
be involved in any way. |

Publicity and Personal Data |
| 29. |
In consideration of being permitted to participate in the competition,
each of the Entrants agree: |
| i. |
to the use of their name and/or likeness, without compensation,
for NGC promotional and marketing purposes; |
| ii. |
to the use of their Film for NGC’s promotional and marketing
purposes and in accordance with the “GEOs” film submissions; and |
| iii. |
to the reasonable use of their personal details like contact
number, e-mail address, etc. for promotional and marketing purposes.. |
Miscellaneous |
| 29. |
Each entrant by entering this competition expressly releases
NGC from any claim, action or demand arising out of or in connection
with the competition or their prize, if any. |

NGC will not pay for the tax & charges incurred with Geo Awards. |
| 29. |
The laws of India govern these terms and conditions, with courts
at New Delhi having exclusive jurisdiction to adjudicate upon any
disputes. |

Call For Entries |
|
“NatGeo Moment Awards” is an initiative by the National Geographic
Channel (“NGC”) to provide a platform for every Indian to tell their
story. With the awards we also intend to set the benchmark for the
best infotainment content and raise the bar of Indian film making
to produce exceptional non-fiction programmes for the global and
Indian audience. Geo Awards is open to all as per the details provided
herein and is not chargeable by money. No subscription to the National
Geographic Channel or any other purchase whatsoever is necessary
for participating in the competition. |
I. Categories |

Still Photography – This category is open to
both professional and amateur photographers of Indian origin. Following
are the sub-categories. |

Mobile Image – This category is open to both professional
and amateur film makers of Indian origin. The mobile images will be
displayed on the website and will be made available for visitors to
view. |

“NGC may change, eliminate and/or add a category at its discretion.
Entry mechanism for all catagories is on-line through http://www.natgeotv.co.in/.
The submission material must be sent to NGC or any other website
which NGC promotes. |
II. Eligibility |
|
All participants must be of Indian origin.
Both preview screeners and exhibition prints must either be in English
/ Hindi.
Participants must be 18 years old. DOB to be calculated from 22nd
March 2009 |
III. Deadlines |
|
All submissions should reach us by April 22 2009.
Submissions later than the deadline will not be considered for competition.
NGC shall not be responsible for any delay/non-delivery of the e-mail
submissions to it. |
IV. Submission Requirements |
|
For the mobile film category 3GP/Real Video/Windows
Media Player formats will be accepted only on the website. The video
files must be not greater than 5 MB in size. |
| I. |
Digital Stills: NGC’s online application requests
a press kit for feature & Short films. Please note that the ONLY
items required for entry are two (2) digital stills. These images
can either be uploaded onto website when you complete your online
entry form or sent on a disc with your preview screeners in jpeg
format only. NGC will not accept paper press kits. Please DO NOT
send them as they will be discarded. |
| II. |
Still Photography: All submissions in this catagory
must also include the following: |
| i. |
All stills shot on film must be submitted with the negatives.
Digital stills must be hi-res (300 dpi) and in jpeg format only.
Mobile Stills must not exceed 1 MB size and should be in jped format
only. |
| ii. |
Each still must be accompanied by a write up on the image |
| iii. |
Each still must have a Caption (title) |
| iv. |
2 photographs of the photographer |

|
Preview Screeners: National Geographic Channel
requires one (1) preview screener per submission. Preview screeners
are accepted on DVD (Region 0 or 1), VCD and VHS PAL. NTSC formats
of any kind are not accepted and will not be considered for submission.
Preview screeners will not automatically be returned. |
V. Rough Cuts |
|
NGC strongly encourages filmmakers to submit a finished version
of their film whenever possible. Should you decide to send a rough
cut, please be aware that NGC will not consider it eligible nor
can it ensure that a newer cut of the programmers will be screened.

NGC does not exhibit works-in-progress. Your film must be completed
by April 22nd09 |
VI. Rights & Clearances |
|
NGC expects all applicants to secure image, performance, music,
talent and other similar intellectual property rights and commercial
rights to their films for broadcast & exhibition in the India territory.
|
|
Applicant represents and warrants that all materials submitted
shall be original work of Applicant (and its employees, if any),
and not of any third party. Applicant warrants that it has good
and marketable title to the entire submitted work. Applicant shall
indemnify, defend, and hold harmless NGC and its affiliate/group
companies and partner(s) from any and all liability, loss, costs,
damage, judgment, or expense (including reasonable attorneys fees)
resulting from or arising in any way out of any such claims by any
third parties and/or which are based upon, or are the result of
any breach of the warranties in this section. |
VII. Selection & Notification |
|
The Primary Contact listed on the entry form will be notified
of their film’s status via email by April 22, 2009. It is the Primary
Contact’s responsibility to update NGC with any change in their
relevant contact information. |
VIII. Awards |
|
Entry into the Geo Awards does not guarantee an award/prize. Each
sub-category will have an award. There will be a separate award
for the mobile phone category. |

Each winner will be gratified within 6 months from the time of
declaration of the results. |
Rules of Entry |
|
In addition to the foregoing requirements, Geo Awards shall be
governed by the Rules of Entry. In the event of any inconsistency
between these details and the terms of the Rules of Entry, the latter
shall prevail. |
