  Terms and Conditions of Participation.
  Terms, Conditions & Selection / Short-listing Procedure for the Mission Army Contest
 
1. The Nat Geo Mission Army Contest ("Contest") is being organized by NGC Network (India) Private Limited ("The Company") The Contestant should be a citizen of India, residing in India and above 18 years of age to qualify for the Contest. All entries must be received during the Term of the Contest, commencing on October 25, 2010 and ending at midnight IST on: November 11 (For Mumbai), November 18 (Bengaluru) and November 25 (Delhi) ("Closing Date"). Only one entry per person is allowed. Multiple entries by one person will lead to disqualification of all submitted entries. No correspondence / calls or communication of any sort to the Company will be accepted on rejected entries. Any entry received after the Closing Date will be invalid.
2. The Contestant should be medically fit to be able to undertake strenuous physical activity and the Contestant agrees to take any test/activity etc. conducted by the Company or the Indian Army for short-listing the Contestant at his/her own risk. The Company or The Indian Army will in no way be liable to any Contestant or any other person in any manner whatsoever for any accident, injury or harm of any sort that any Contestant may suffer as a result of participating in this Contest and the Contestants and their families acknowledge that they are entering into this Contest entirely of their own free will.
3. Proof of nationality and citizenship is a must for each Contestant (such proof being either a passport or an election identity card)
3. Proof of age is a must for each Contestant and must be submitted to the Company (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate).
4. The Contestant should not have any criminal background and the Company holds the right to check the Contestant's background any time after the Contestant is short-listed and disqualify any Contestant in case he/she has any criminal background.
5. The Company reserves all rights to make amendments to the existing rules or extend the period or cancel or discontinue the Contest or any part thereof without prior notice.
6. Non-conformance by any Contestant of the rules of the Contest will disqualify them from participating in the Contest.
7. By participating in the Contest, the Contestant agrees and acknowledges having read and understood all rules and regulations of this Contest.
8. Incomplete entries will not be entertained and will be disqualified.
9. The Contestant agrees that he/she shall hold harmless the Company, its affiliates, The National Geographic channel, its employees, Indian Army or any other person in connection with the Contest and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against Company and/or the channel to claim any damages or relief.
10. The final five Contestants will get the opportunity to experience select aspects of the life of the Indian Army personnel and will also get the opportunity to visit select Army bases throughout the country.
11. The Contestant shall bear his/her own costs (including travel, boarding and lodging) till the first selection stage at point 3 of the procedure for short-listing.
12. At every stage of the selection process, and every short-listing, the Contestant may be required to complete paperwork and give declaration and/or indemnity as specified by the Company. In the event, any of the Contestants does not fulfill or is unwilling to fulfill these obligations, the Contestant will be disqualified from the Contest and the Company shall have no obligations whatsoever in such cases.
13. In the event of Contestant being short-listed at any stage, the Contestant will be informed at the contact address or e-mail address or mobile phone number provided by him/her. The message will give instructions as to the next steps and other details as regards the venue, date and time. The Company shall not be responsible or liable for any non-receipt of intimation by the Contestant. A list of short-listed Contestants will also be posted on the Company's website located at http://www.natgeotv.co.in/missionarmy 15. No correspondence of any nature shall be entertained with regard to the Contest.
14. The decision of the Company shall be final and binding on all Contestants or any related parties/entities.
15. Employees of the Company, its associate companies, all partner Cellular Telephone Operators, Taproot India, Genesis PR, Icreon Communications and their associate companies, any sponsor of the contest, and their immediate family member(s) and/or those with criminal convictions, persons other than citizens of India, are not eligible to enter the Contest.
16. By entering the Contest, each of the Contestants agrees to the use by the Company in any manner, for any purpose, at any time and in any medium:

(a) Their name and/or likeness, without compensation; and
(b) Their answers to the questions
17. Contestants agree to indemnify the Company, its agents, employees, representatives, associates, affiliates, parent and subsidiary companies against any and all claims, losses, costs, damages, liability and expenses, if any, arising out of the Contestant's participation in this Contest. The Contestant agrees that he/she shall hold harmless the Company, its employees, officers or any other person in connection with the Contest and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the Company and/or the channel to claim any damages or relief in connection with the Contest or any matter related to it.
18. The short listed Contestants may be required to complete paperwork and give declaration and provide such indemnity as is specified by the Company in its sole and absolute discretion. In the event the winner does not fulfill this obligation or is unwilling to fulfill this obligation, the Contestant will be disqualified from the Contest.
19. Each Contestant, by entering this Contest, expressly releases the Company from any claim, action or demand arising out of or in connection with the Contest, if any.
20. Disputes if any will be settled within the exclusive jurisdiction of the courts of Delhi and in accordance with Indian law. The Contestants, by entering the Contest, shall be deemed to have unconditionally waived the right to resort to any legal proceedings of any kind whatsoever outside Delhi for enforcing any claims or rights arising out of or in connection with the Contest, even if the Contestants reside outside Delhi or India.
21. This Contest is not open to the residents of States where such Contests are not permitted under the applicable law.
22. The decision of the Company in relation to the Contest shall be final and binding on all Contestants and their families and shall not be challenged/questioned on any ground.
23. The Company shall not be responsible or liable for any loss or damage of any entry, due to technical reasons such as disconnection, Act of God, Government actions, hacking, data corruption or other force majure circumstances, and will not be liable to pay any amount or compensation whatsoever to any Contestant for any loss arising therefrom.
24. All Contestants agree to abide by the rules including the general rules.
 
PROCEDURE FOR SHORTLISTING
 
1.

The Contestant applications should be received by the Company by either of the three modes
(i) via competition post-card
(ii) via the online form located on the company's website at www.natgeotv.co.in/missionarmy, or (iii) Short Messaging System ("SMS") sent to 5667722 To enter, Contestants must correctly answer the questions set out in the Contest entry form. Contestants using the SMS mode of entry are required to correctly answer the questions asked via SMS. Contestants shall be bound by these terms, conditions and rules, regardless of the mode of entry for the Contest. No subscription to the National Geographic Channel or other purchase is necessary for entry in this Contest. Any entry made giving another person's (or a false) name or other dishonest information shall disqualify a Contestant. All liabilities and consequences arising on account of such misrepresentation will be the responsibility of the person submitting such incorrect or false information. All entries that are submitted shall become the property of the Company. The Company shall not be held responsible for any non-delivery of e-mail or SMS notification. Any email or SMS not received by the Company even if such email or SMS reaches the system of the email or SMS service provider will not be considered as a valid entry. The Company will entertain no correspondence of any sort regarding non-receipt of e-mail or SMS and shall have no liabilities of any kind whatsoever in this regard.

2. The Company will first shortlist 2,500 (Two Thousand) Contestants on the basis of calculation of their Body Mass Index (BMI) and whether such BMI falls within the limits as maybe required by the Company for this Contest. The BMI will be calculated on the basis of the submitted height and weight ratio information provided by the Contestant. If there are more than 2,500 Contestants with the requisite BMI, then the Company will select 2,500 Contestants by way of a computerized random selection. Any candidate who provides incorrect information will be disqualified forthwith from the Contest.
3. These 2,500 short-listed Contestants will then be required to participate for one complete day of various physical tests, psychological tests, and interviews at the zonal venue at Delhi, Bangalore and Mumbai. The Company will intimate the venue, date and time to the short-listed Contestants for the event. In a case where the Company is not able to provide the test to all the short listed Contestants on the designated day at each of the zonal venues then the opportunity to appear for these tests will be afforded strictly on a first-come-first-served basis.
4. On the basis of the above tests, the Company will select 5 Contestants from each of the zonal centers located at Delhi, Bangalore and Mumbai. A total of fifteen Contestants will be selected at this stage. These thirty short-listed Contestants will then be required to participate in three to four days of further training and selection process conducted by the Company and the Indian Army in New Delhi.
5. Post the above further training and selection process, the Company will intimate the thirty short-listed Contestants of the next steps to be taken, including the venue, date and time for the further training & selection process. In the event any Contestant does not confirm his/her willingness to participate further and/or does not complete all formalities of participation within two days of such intimation to the Contestant, then it will be deemed that Contestant is not willing to participate any further and the Company has a right to choose the next best Contestant for further training.
6. At the completion of the above-mentioned three to four days of further training & final selection, the Company will short list the final five Contestants.
7. Post the above selection, the Company will intimate the final five Contestants of the next steps to be taken. In the event any Contestant does not confirm his/her willingness to participate further and/or does not complete all formalities of participation within one day of such intimation to the Contestant, then it will be deemed that the Contestant is not willing to participate, and the Company reserves the right to choose the next best Contestant.
8. These final five Contestants will be given the opportunity to experience select aspects of the life of the Army personnel, which will include select aspects of the training and the other activities undertaken at the bases of the Indian Army for a specified period.
 
SMS RULES
 
1. In order to participate in the Contest, the Contestant requires to register oneself during the Term of the Contest, by sending the keyword Mission as an SMS to 5667722 or online by logging on to www.ntgeotv.co.in/missionarmy. On receipt of the SMS, the Company will revert with a SMS requesting for information, i.e., name, gender, city, etc. The Contestant is required to revert via SMS immediately with the correct information.
2. The valid format for sending the response is in the following format: Age, Height (in Cms), Weight (in Kgs) e.g. Anil, 24, M, 165, 65.
3. The short-listed Contestant will be informed via SMS the venue, date and time for the next round of selections.
4. All the General Rules will be applicable to the Contestants.
 
INTERNET RULES
 
1. By completing the online electronic registration process and clicking the submit button, the Contestant acknowledges that he/she has read the rules and agrees to be bound by the provisions of these rules. The registration will be open during the Term of the Contest on the website of the National Geographic Channel, India, located at http://www.natgeotv.co.in/missionarmy
2. Each Contestant has to register for the Contest using his/her e-mail address on the online entry form available on the website of National Geographic Channel, India.
3. In the event of being short-listed, the Contestant will be intimated by e-mail at the e-mail address specified by the Contestant in the online entry form after the registration period is over and Contestants are short-listed. The message will inform the short-listed Contestant the venue, date and time for the next round of selections. The Company shall not be responsible or liable for non-receipt of intimation by e-mail.
4. All the General Rules will be applicable to the Contestants.
